Reciprocal Certification Procedure

The Applicant shall submit the Uniform Application Checklist for Reciprocal Reinsurers Jurisdiction initial and renewal applications and any other reasonable requirements deemed necessary for certification by the Commissioner. Upon notice and approval of the application, the effective date will be as of the beginning of the quarter in which the application is received. Please see Delaware Title 18, Section 911(6) and Delaware Administrative Code 1003 – Credit for Reinsurance, Section 9 for the applicable law and regulation on reciprocal reinsurers.
 

Forms and Fees

A reciprocal jurisdiction reinsurer must submit its initial or renewal application electronically to us at BERG@Delaware.gov.

The filing fee by check, money order or cashier check made payable to Delaware Department of Insurance; must be mailed to us at the following address:

Please note that Delaware is a retaliatory state therefore if the charge for this application is higher in the company’s domicile state that fee would be required.
 

Application for Delaware to be Lead State

A Reciprocal Jurisdiction Reinsurer requesting Delaware to act as its “Lead State” and passporting purposes should file a full application, will need to complete Section I on the Uniform Checklist for Reciprocal Jurisdiction Reinsurers, and filing all of the necessary corresponding exhibits detailed in that section of the checklist.

Lead State Annual Renewal Applications are due with all required documents and fees no later than June 30th.
 

Application for Passport

A Reciprocal Jurisdiction Reinsurer who has established its Lead State other than Delaware, will need to complete the Section II on the Uniform Checklist for Reciprocal Jurisdiction Reinsurers, and file all of the necessary corresponding exhibits detailed in that section of the checklist.

Passport Annual Renewal Applications are due with all required documents and fees no later than December 1^st.

*Please do not submit passport applications if the Lead State approval has not yet been received.
