Premium Taxes & Fees

The Premium Tax and Fees Section is responsible for the tax regulation of all insurance companies, whether admitted or non-admitted, that are authorized, approved, or registered to transact business in the state of Delaware. This includes responsibility for the timely preparation, collection, recording, analysis, and reporting of all insurance premiums, taxes, and fees; and for ensuring company compliance with Delaware insurance tax laws and other applicable laws in the Delaware Code. In addition, all Risk Purchasing Group applications for registration are reviewed by the Premium Tax and Fees Section, and Risk Purchasing Group regulation falls to this Section of the Department. Another function of the Premium Tax and Fees Section is the regulation of Surplus Lines brokers, including policy reporting and compliance enforcement, along with the collection of surplus lines premium tax.

Action Required: All companies writing lines of business listed in the Working Form T-5 (per 18 Del. C. § 705) should submit to the Department by November 20, 2023, an action plan detailing how they plan to resolve reporting problems and implement changes for calendar year 2023 data collection. Action plans should be emailed to doi_tax@delaware.gov.

Effective January 1, 2018, the use of OPTins became mandatory for the filing of all premium tax reports and payments. Paper or emailed forms will not be accepted, and will be returned to the sender. Please note: There is a registration process to obtain an OPTins user ID and password, which could take two weeks or more to complete, therefore, industry users are advised to begin the set up process within 30 days of the tax due date. Each insurance company must set up an individual account. Captive Insurers

  • 2023 Captive Annual Form REVISED: 1/31/2023 – All Delaware Captive Insurers, except Sponsored Captive Insurers and Protected Cells or Series Captive Insurers, but including Delaware domiciled Risk Retention Groups, should use this form. Sponsored Captives and Protected Cells or Series Captives use the appropriate form below.

  • 2023 Quarterly Tax Form REVISED: 10/30/2023 – For use by captive insurers that pay more than minimum tax and choose to pay the estimated tax quarterly. See directions on the form.

Captive Insurers that choose to dissolve during calendar year 2024 are required to pay the minimum tax for 2024, regardless of the dissolution date. The following 2024 annual forms have been prepared for this purpose.

Please be sure to download the actual spreadsheet file for data entry. The Files contain formulars; therefore, it is vital for you to select on the form if it is dormant or not. This will ensure the correct formular is utilized for you to calculate the correct Premium Tax Due for your entity.
