Pursuant to the Federal Health Care Reform, the Delaware legislature enacted HB 420, creating Chapter 61 of Title 18 , effective September 23, 2010. This section prohibits rescissions based on post claims underwriting of any health insurance policy except in cases of fraud or intentional misrepresentation of a material fact.
Carriers seeking to rescind a health insurance policy must email the completed Rescission Application and all supporting documentation to compliance@delaware.gov. The email subject line must read: Rescission Application.
